The Director of Public Prosecutions has requested the Milimani Law Courts to approve the extradition of Kenyan citizen Brian Kiprop Kiplagat to the United Kingdom to answer to murder charges. Presenting arguments before the judiciary, prosecution counsel Dancun Ondimu asserted that the scope of the extradition proceedings is restricted to confirming the identity of the individual and verifying whether the underlying offenses are political. The state contested Kiplagat’s efforts to present evidence contesting the validity of the extradition request, emphasizing that the court is not holding a trial and ought not to evaluate the substance of the claims. The office of the DPP informed the judiciary that Kiplagat is sought in connection with the killing of another Kenyan citizen and reportedly traveled back to Kenya following the incident. Regarding the suspect’s mobile phone, the prosecution noted that the device is tied to a Mutual Legal Assistance request and serves as evidence in the active inquiry. Additionally, the prosecution guaranteed that Kiplagat’s constitutional rights remain safeguarded, highlighting that he has medical access and that unrelated personal property will be given back to him. The court was further apprised that a duplicate of Kiplagat’s national identification card could be accessed via the lead investigator, prompting a request from the defense to retrieve the document. The bench stated that the investigating officer would confirm the availability of the identification card prior to scheduling its retrieval. The state reiterated that adequate justification has been established to approve Kiplagat’s transfer to the United Kingdom to face prosecution. Kiplagat faces several accusations in the UK, encompassing murder, manslaughter, obstruction of justice, and fraud through false representation.
