Japheth Kamanda Mogambi appeared before the Nyamira High Court regarding a family dispute that resulted in the death of his brother.
The accused informed the court that the incident on November 23, 2023, at approximately 7pm was completely unplanned.
“This was never intended,” Kamanda stated before Justice Thripsisa Cherere.
Court testimony revealed that Abel Mogambi came home intoxicated that evening, sparking a conflict about maize stalks reserved for livestock.
The situation intensified when the deceased approached his brother about the maize stalks.
During the physical confrontation, Abel Mogambi slipped, fell on stones, and suffered injuries.
Witnesses confirmed there were no visible signs of blood at the location when the incident took place.
Ezekiel Isaboke, another brother, transported the injured man to hospital after discovering him in agony.
Despite medical attention, Abel Mogambi died from his injuries, leading to police inquiries and the subsequent arrest of the accused.
In his defense, Kamanda insisted he held no animosity toward his sibling.
“I had no issues with my brother whatsoever,” he emphasized.
The case has sparked community concern about alcohol-fueled family conflicts.
The court was informed that the parents, who were home during the incident, could not attend proceedings due to health reasons.
The case will resume on July 15.
