Former Nairobi Provincial Commissioner Davis Nathan Chelogoi has received a three-year prison sentence following his conviction in a Ksh1.35 billion land fraud matter.
During the sentencing on Monday, November 2, Milimani Chief Magistrate Dolphina Alego evaluated arguments presented by both the prosecution and the defence, together with the victim impact assessment.
Chelogoi was handed concurrent terms across multiple counts, resulting in an effective three-year incarceration period.
Alego detailed the concurrent prison terms for each count during the court session.
The dispute centered on a valuable 7.39-hectare property situated along Lower Kabete Road, estimated at Ksh1.35 billion, which triggered an extensive legal dispute.
State counsel demonstrated that Chelogoi unlawfully secured and registered the real estate between May 2020 and June 2021.
The retired official utilized counterfeit title documents, a fabricated registry file, and fraudulent signatures to substantiate his assertions.
Land Registrar Pauline Achieng Pesa testified that the official stamps and signatures attributed to her on the contested paperwork were fabricated.
Furthermore, investigators discovered that the Ministry of Lands lacked genuine historical documentation to validate Chelogoi’s acquisition prior to the contested 2021 registration.
The aggrieved parties, investors Ashok Rupshi Shah and Hitenkumar Amritlal Raja, had acquired the real estate from Lima Company Limited during January 2007 for Ksh33 million.
Their legal title had earlier been sustained by the 2022 ruling and subsequently confirmed by the Court of Appeal.
Despite Chelogoi’s assertions that he purchased the property in January 1995 for Ksh2.48 million, the magistrate dismissed his arguments.
Alego directed that the victim impact evaluation be incorporated into the official record and advised the defendant of his 14-day appeal window.
