The Employment and Labour Relations Court in Kisumu has dismissed a case by Isaac Olwero, the former Clerk of the Siaya County Assembly, challenging his dismissal over an alleged irregular Sh2 million loan.
Olwero argued that the loan had been properly approved, that he had repaid over Sh1.2 million, and that his removal was unfair and procedurally flawed. He claimed denial of access to critical documents and cited a road accident for missing the assembly committee hearing.
The court, however, found that Olwero had processed the loan to himself contrary to policy, failed to disclose it in his asset declaration, and refused to utilize fair hearing opportunities provided. Justice Nzioki wa Makau ruled that Olwero’s claims of malice and improper motive were unproven.
While dismissing the case, the court did not award costs against Olwero, recognizing the hardships he has endured since his dismissal.
